SPECIAL EVENT, VIDEO, PHOTOGRAPH, AUDIO RELEASE FORM AND LIABILITY WAIVER

By participating in this Special Event I understand that I and my guests will participate at our own risk.

1. Assumption of Risk. I expressly acknowledge that I am participating in the Special Event and any or all of the activities involved with the Special Event completely voluntarily and in no way hold Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc. responsible for any liability, injury, death or loss, involved.

2. Waiver and Release. I waive and releaseOcean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc. and its Board of Directors, Marinas, Sponsors, fellow participants agents and/or those connected with the event from all claims for any liability, injury, death, loss or damage in any way connected with or arising out of my participation in the Special Event.

3. Indemnification. I agree to indemnify and hold harmless (in other words reimburse and be responsible for) Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc. and it’s Board of Directors , Marinas, Sponsors, fellow participants agents and/or those and/or those connected with the Special Event from all claims for any liability, injury, death, loss or damage in any way arising out of my participation in the event.

4. Medical Attention. I agree that Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc.  will not provide me with medical care or medical attention and that participation in the Special Event is totally voluntary and I participate at my own risk.

5. Binding Effect. This instrument shall be binding upon my relatives, personal representatives, heirs, beneficiaries, next of kin, or assigns and shall inure to the benefit of Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc.

6. Invalidity / Unenforceability. If any provision of this instrument is held to be invalid or unenforceable, this instrument shall be construed as if such valid or unenforceable provision was not contained herein.

7. Applicable Law. Because Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc.   is located in several countries, and in order to provide certainty in the law to be applied to the construction of this instrument, this instrument shall be governed, construed and enforced in accordance under maritime law.

8. I hereby grant Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc.   the irrevocable right and permission to use photographs and/or video recordings of me at Panama Posse Events and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to me.

9. I understand and agree that such photographs and/or video recordings of me may be placed on the Internet. I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings of me. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc.

10. I hereby release, acquit and forever discharge the Ocean Posse LLC, Pacific Posse, Atlantic Posse,  Panama Posse and Good Nautical Inc. its current and former trustees, agents, officers and employees of the above-named entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation.

11. I hereby warrant that I am eighteen (18) years old or more and competent to contract in my own name or, if I am less than eighteen years old, that my parent or guardian has signed this release form below. This release is binding on me and my heirs, assigns and personal representatives.

12. Any minors or underage individuals you bring with you may be subject to adults – adult behavior and adult language. This is an adult event and any minors are under your direct responsibility.

I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I AM SIGNING THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT VOLUNTARILY.
